These Terms of Use govern the purchase of Moodle themes, plugins, and related digital products ("Products") from Mariusz Boloz - LmsStyle ("LmsStyle", "we", "us", or "our").

LmsStyle operates online under the brand name LmsStyle and the marketplace author name marbol2, including on ThemeForest and other Envato marketplaces.

By purchasing any Product from LmsStyle, you agree to these Terms of Sale.

Products

LmsStyle develops and sells digital products, such as:

• Moodle themes
• Moodle plugins
• Related digital products and services

All Products are delivered electronically and require a compatible Moodle installation.

Product licensing

Components of LmsStyle Moodle themes and plugins that are derived from or integrated with Moodle are licensed under the GNU General Public License (GPL), in accordance with Moodle licensing requirements.

Where GPL applies, your rights to use, modify, and redistribute those components are governed entirely by the GPL.

Other components of the Products, including but not limited to design assets, branding elements, documentation, and proprietary tools or services, are licensed to you under a non-exclusive, non-transferable commercial license granted upon purchase, unless otherwise stated.

This license permits you to use these components solely as part of the Product within a single end-user Moodle installation.

Nothing in these Terms is intended to restrict any rights granted to you under the GPL. Where applicable, the GPL shall take precedence over these Terms.

Acceptable use

You agree not to:

• Use our website or Products in any way that violates applicable laws or infringes the rights of others.
• Try to access systems, accounts, or data that do not belong to you or for which you do not have authorization.
• Scan, probe, or test the security or vulnerabilities of our infrastructure without prior written permission.
• Disrupt, interfere with, or negatively impact the normal operation of our website, services, or Products.
• Sell, share, or distribute any part of the Products unless this is explicitly allowed under your license or applicable open-source licenses (including the GNU General Public License (GPL), where applicable).
• Use the LmsStyle name, branding, trademarks, or product identity in a way that may suggest endorsement, affiliation, or official involvement where none exists.

Pricing and payment

All prices are displayed in the currency shown at checkout. Applicable taxes may be added where required by law. Full payment must be received before access to the Product is granted. We reserve the right to change pricing at any time, but such changes will not affect completed purchases.

Accepted payment methods are displayed during checkout.

Digital delivery

Products are delivered electronically after successful payment.

Delivery is typically immediate, although occasional delays may occur due to technical issues.

Customers are responsible for:

• Maintaining access to their account.
• Downloading Products promptly.
• Keeping backup copies of purchased files.
• Ensuring compatibility with their Moodle environment.

Updates

Where updates are included with the purchase:

Update schedules are provided at our discretion and are not guaranteed.

Where support is included with the purchase, support may include:

• Guidance relating to supported third-party components included with the Product.
• Investigation of reported bugs, defects, and technical issues.

Unless explicitly included in the Product description, item support does not cover the following:

• Modifying or extending the Product beyond its original features, design, and functionality as described on the Product page.
• Installation or initial setup of the Product on your Moodle system.
• Hosting services, server configuration, or assistance with software and infrastructure environments.
• Support or assistance from the authors of any third-party assets, libraries, or components included with the Product.

If you require customization services tailored to your specific needs, you may contact LmsStyle to check whether such services are available on a paid basis.

Compatibility

We make reasonable efforts to ensure compatibility with the Moodle versions listed on each Product page.

However, we do not guarantee compatibility with:

• Unsupported Moodle versions.
• Customized Moodle installations.
• Third-party plugins.
• Third-party themes.
• Custom code modifications.

Customers are encouraged to test Products in a staging environment before deploying them to production systems.

Refund policy

Because our Products are digital goods delivered electronically, refunds are generally not available once access to the Product has been granted.

Refund requests may be considered when:

• The Product contains a reproducible defect that substantially prevents its intended use.
• We are unable to provide a reasonable fix or workaround.
• A refund is required by applicable consumer protection laws.

Refund requests must be submitted within 14 days of purchase and include sufficient information to investigate the reported issue.

We reserve the right to deny refund requests where:

Intellectual property

While Moodle themes and plugins are distributed under the GPL:

The LmsStyle name, branding, logos, graphics, website design, screenshots, documentation, and marketing materials remain the intellectual property of Mariusz Boloz - LmsStyle. No trademark rights are granted through any Product purchase.

Customers may not represent themselves as LmsStyle or marbol2.

Customer responsibilities

Customers are responsible for:

• Maintaining secure backups.
• Testing the software before deployment.
• Ensuring compliance with applicable local laws and regulations.
• Keeping their Moodle installation up to date and secure.

Customers acknowledge that software may contain unforeseen bugs despite testing and quality assurance efforts.

Disclaimer of warranties

To the fullest extent permitted by law, all Products are provided on an "as is" and "as available" basis.

LmsStyle makes no warranties, express or implied, including but not limited to warranties of:

• Merchantability.
• Fitness for a particular purpose.
• Non-infringement.
• Continuous availability.
• Error-free operation.

We do not guarantee that Products will meet every customer requirement.

Limitation of liability

To the maximum extent permitted by applicable law:

LmsStyle shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages. This includes loss of profits, loss of revenue, loss of data, business interruption, or reputational harm.

Our total liability arising from any claim relating to a Product shall not exceed the amount paid by the customer for that Product.

Suspension and termination

We reserve the right to suspend or terminate access to support services if:

• Fraudulent activity is suspected.
• Abuse of support services occurs.
• Payment disputes or chargebacks are initiated.
• These Terms are violated.

Termination of support services does not affect rights granted under the GPL.

Governing law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Poland, without regard to conflict of law principles.

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

Changes to these terms

We reserve the right to update or modify these Terms of Sale at any time.

Changes become effective upon publication on our website and apply to purchases made after the publication date.
